Terms of Service
Version 1.0 · 29 October 2026
These terms are for businesses (not consumers). Your data stays yours, you can export it or leave at any time without charge, and we process your customers' data only as your processor under our Data Processing Agreement. These are drafts during the pilot and will be reviewed by a solicitor before general launch.
1. About these terms
These terms are an agreement between Daniel Brennan, a sole trader trading as Aftermade, of Unit B7, Smithstown Industrial Estate, Shannon, Co. Clare, Ireland ("Aftermade", "we") and the business that creates an Aftermade workspace ("you"). If Aftermade is transferred to a company we control, we may transfer this agreement to it with notice to you; your rights under it will not be reduced.
The person accepting them confirms they are authorised to bind the business. Aftermade is supplied for business purposes only, not to consumers. The Data Processing Agreement and any order form or pilot agreement we sign with you form part of these terms. An order form or pilot agreement prevails over these terms where they differ.
2. The service
Aftermade lets you track made-to-order work in your workshop, record photos and measurements, show each of your customers a private page about their order, record shipping and delivery, and issue a Certificate of Build. We will provide the service with reasonable skill and care.
We may improve or change features, but we will not materially reduce the core service during a paid period without notice and a right to end it. During a pilot the service may change more often. We will tell you about anything that affects how you work.
3. Your account
You must give accurate details, keep sign-in details and two-step codes secure, and tell us at once at hello@aftermade.app about any unauthorised use. You are responsible for your users' actions, and for who you invite and the roles you give them. Business sign-up is currently by invitation code.
4. Fees
Fees, if any, are as agreed in your order form or pilot agreement and are invoiced as stated there, plus VAT where applicable. Unpaid invoices more than 30 days overdue may lead to suspension after written notice.
5. Acceptable use and content rules
You must not use Aftermade to:
- break any law, or upload content that is illegal, including content that infringes intellectual property rights, is defamatory, or relates to the sale of illegal goods;
- enter special categories of personal data (such as health information) or data about criminal convictions;
- upload malware, try to access other businesses' data, probe or overload the service, or get around its security or usage limits;
- send unsolicited marketing through the service;
- resell the service without our written agreement.
We don't monitor content in advance. If we become aware of illegal content or a breach of these rules, we may remove or disable the content, or restrict or suspend accounts, in proportion to the problem. We will tell you why, with a clear statement of reasons, unless the law prevents it (Regulation (EU) 2022/2065, the Digital Services Act, Article 17).
You can dispute a decision by replying to that notice. We will review it promptly and in good faith.
6. Reporting illegal content (Digital Services Act)
Anyone can report content on Aftermade they believe is illegal by emailing hello@aftermade.app. Please include:
- why you believe the content is illegal
- where exactly it is (for example, the page address)
- your name and email address, unless the report concerns certain serious offences involving children
- a statement that you believe the report is accurate and complete, in good faith
We will confirm receipt, handle the report diligently and objectively, and tell you our decision (DSA Article 16).
Our single point of contact for authorities, the European Commission and the European Board for Digital Services, and for users (DSA Articles 11 and 12), is hello@aftermade.app, in English.
7. Your data
You own the data you put into Aftermade ("Your Data"). You give us a licence to host, copy, display and process Your Data only to provide, secure and support the service for you.
For personal data, we act as your processor under the Data Processing Agreement. You are responsible for having a lawful basis for the customer data you enter, and for giving your customers the information the GDPR requires. You can link to our notice for customers for the Aftermade part.
We may use anonymous, aggregated information about how the service is used (for example, how many orders are tracked) to run and improve it. This never identifies you, your customers or your users.
8. Leaving Aftermade and taking your data (EU Data Act)
You can end your use of Aftermade at any time, on notice of no more than two months. You can switch to another provider or to your own systems (Regulation (EU) 2023/2854, the Data Act, Chapter VI).
- Export: you can export all of Your Data at any time, from the Business page, in a structured, commonly used, machine-readable format (JSON). Photos and logos are provided on request.
- Transition: we will help you with switching in good faith. You can retrieve Your Data for at least 30 days after the end of your notice period.
- No switching charges: we do not charge for switching or for exporting your data.
- Deletion afterwards: after the retrieval period, or sooner if you delete your business yourself, we delete Your Data as set out in the Data Processing Agreement.
9. Our intellectual property
We (and our licensors) own Aftermade, its software, design and brand. You receive a non-exclusive, non-transferable right to use it for your business during the term. Feedback you give us may be used freely to improve the service.
10. Availability and support
We aim to keep Aftermade available around the clock, but don't guarantee uninterrupted service, especially during the pilot. We will try to schedule maintenance outside working hours, keep daily backups, and tell you promptly about significant incidents. Support is by email at hello@aftermade.app.
11. Confidentiality
Each party will keep the other's non-public business information confidential, and use it only for this agreement. This does not apply to information that becomes public through no fault of the receiver, or that must be disclosed by law.
12. Warranties and liability
Except as expressly stated in these terms, the service is provided without other warranties, to the extent the law allows.
Neither party is liable for indirect or consequential loss, or for loss of profit, revenue or goodwill. Each party's total liability in any 12-month period is limited to the greater of the fees you paid in that period and €1,000.
Nothing limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Liability for breaches of data protection law is governed by the GDPR (including Article 82), together with these limits where the law allows.
13. Suspension and ending
We may suspend access, where reasonably necessary, to protect the service, other businesses or the public, or for serious or repeated breaches of these terms. Where practical, we will give notice first.
Either party may end the agreement for material breach not fixed within 30 days of written notice. Sections 7, 8, 11, 12 and 15 survive the end of the agreement.
14. Changes to these terms
We may update these terms. We will email account owners at least 30 days before material changes take effect, except where a change is required by law. If you don't agree, you may end your use before the change takes effect (see section 8).
15. General
These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, without affecting any mandatory rights you have.
Neither party is liable for delays caused by events beyond its reasonable control. You may not assign these terms without our consent. We may assign them to a successor to our business, with notice to you.
If any part is found unenforceable, the rest stays in force. These terms, the DPA and any order form or pilot agreement are the whole agreement between us about the service.
Notices to us go to hello@aftermade.app, and to you, to the owner's email address.
